We understand that occasionally issues may arise, and we have established a clear and comprehensive Resolution Policy to address any concerns or disputes that may occur during the course of your project. Our goal is to resolve any issues promptly, fairly, and transparently.
1. Submitting a Claim
If you encounter any issues with your flooring installation, materials, or any aspect of our service, please contact Floor Daddy, LLC as soon as possible. Claims must be submitted promptly after the issue is discovered and within the applicable warranty period.
To submit a claim:
Call us at (602) 313-3000 to request warranty servicing. Provide detailed information about the issue, including the nature of the problem, the date it was discovered, and any relevant documentation.
Once your claim is received, we will schedule an appointment to inspect the premises and assess the situation within a reasonable period of time.
2. Inspection and Resolution
After our inspection, if we determine that a valid claim exists under one or more of our warranties, Floor Daddy, LLC will take appropriate action to resolve the issue. This may include:
Repair: If the issue can be resolved through repair, we will arrange for the necessary work to be completed by an authorized contractor.
Re-installation: In cases where re-installation is required, we will perform the service at no additional cost to you.
Replacement: If the product is deemed defective and requires replacement, we will substitute the product with one of equal quality. Please note that minor color variations may occur between the original product and the replacement, which is not considered a defect.
Refund: In some cases, Floor Daddy, LLC may offer a refund of the purchase price for the affected service or product. If a refund is issued, all warranties related to that service or product will be terminated.
3. Non-Warranty Service Calls
If your issue falls outside the scope of our warranties, or if it is determined that the problem is due to factors not covered by our warranties (such as improper maintenance, acts of God, or modifications to the installation), you may still request service from Floor Daddy, LLC. However, non-warranty service calls will incur a $100 processing fee, in addition to any costs associated with repairs or adjustments.
4. Arbitration and Dispute Resolution
In the event of a dispute, claim, or controversy arising under or relating to this agreement or any work performed by Floor Daddy, LLC, such matters will be resolved through binding arbitration in accordance with the Construction Industry Rules of the American Arbitration Association. Arbitration replaces the right to go to court, and you agree to waive any right to a jury trial or the opportunity to litigate claims in court.
5. Limitation of Liability
Floor Daddy, LLC assumes no liability for any damages resulting from delays, unforeseen circumstances, or conditions beyond our control. This includes, but is not limited to, issues related to subfloor conditions, installation of materials not provided by Floor Daddy, LLC, or any modifications made to the installed flooring that affect its performance.
6. Finality of Agreement
This Resolution Policy, along with your original sales agreement and any addenda, constitutes the entire agreement between you and Floor Daddy, LLC. No oral modifications or agreements will be recognized. Any changes to this policy must be documented in writing and signed by both parties.
